Welcome to CuddleBerry. This website, www.cuddle-berry.com, is owned and operated by Mohita Goyal (trading as Shree Radha creations), Lincon 102, Grand Omaxe, Sector 93B, Noida, Gautam Buddha Nagar, Uttar Pradesh 201304 (GSTIN: 09AMWPG8468Q1ZN). By accessing or purchasing from the Site you agree to these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place an order.
2. Products and pricing
- We make every effort to display product colours and details accurately; slight variations may occur due to screen settings and the nature of fabric prints.
- All prices are in INR and inclusive of applicable taxes unless stated otherwise. Prices and availability may change without notice.
- We reserve the right to cancel an order in case of a pricing or listing error or stock unavailability, with a full refund of any amount paid.
3. Orders and payment
An order is confirmed only after successful payment (or acceptance for Cash on Delivery where available). Payments are processed securely through Razorpay and other authorised payment partners. We do not store your card or banking credentials.
4. Shipping, returns and refunds
These are governed by our Shipping & Delivery Policy and Cancellation, Return & Refund Policy, which form part of these Terms.
5. Size and care
Please refer to the size guide and care instructions on each product page. Garments are intended for use under adult supervision. Pyjama sets are not flame-resistant; keep children away from open flames.
6. Intellectual property
All content on the Site, including the CuddleBerry name, logo, the characters Cuddle and Berry, artwork, photographs and text, is the property of Mohita Goyal (trading as Shree Radha creations) and may not be copied, reproduced or used without written permission.
7. Prohibited use
You agree not to misuse the Site, attempt unauthorised access, post unlawful content, or use it for fraudulent purposes.
8. Limitation of liability
To the extent permitted by law, CuddleBerry is not liable for indirect or consequential losses arising from use of the Site or products. Our total liability for any claim is limited to the amount paid for the relevant order.
9. Governing law and jurisdiction
These Terms are governed by the laws of India. Courts at Noida, Uttar Pradesh shall have exclusive jurisdiction, subject to your rights under the Consumer Protection Act, 2019.
10. Changes
We may update these Terms at any time. Continued use of the Site means you accept the updated Terms.
